TERMS OF SERVICE

WARNING: ACCESSING OR USING Zush Digital Hub, ITS WEBSITES, DISCORD BOTS, APIs, OR AFFILIATED SYSTEMS CONSTITUTES A LEGALLY BINDING AGREEMENT. IF YOU DO NOT AGREE WITH ANY CLAUSE, CEASE USAGE IMMEDIATELY.
1. ACCEPTANCE, CAPACITY & SCOPE
1.1 Binding Agreement. By accessing the Zush Digital Hub (“Service”), you (“User”) agree to all terms, policies, and notices incorporated herein.
1.2 Legal Capacity. You confirm that you:
- Are legally competent to enter into a contract;
- Are not barred under any applicable law from using digital services;
- Are acting on your own behalf and not as a representative of any sanctioned or restricted entity.
1.3 Territorial Scope. These Terms apply globally, including but not limited to:
- GDPR (EU/EEA)
- UK Data Protection Act (UK)
- CCPA/CPRA (California)
- PIPEDA (Canada)
- IT Act 2000 (India)
2. DISCORD PLATFORM COMPLIANCE
Zush operates as a Derivative Service built on the Discord API.
2.1 Discord Terms of Service Compliance. You MUST follow Discord’s ToS. Violation = Instant Zush suspension.
2.2 Discord Community Guidelines. You agree to follow all provisions, including zero tolerance for:
- Hate Speech & Harassment
- Terroristic Threats
- NSFW Content Involving Minors
- Illegal Activities
- Social Engineering & Phishing
- API Manipulation
- Circumvention of Discord’s Safety System
Failure to comply may result in:
- Account termination
- Reporting to Discord Trust & Safety
- Reporting to relevant cybercrime authorities
3. PROHIBITED CONDUCT
(Including CFAA, DMCA, GDPR, IT Act 2000, etc.)
3.1 Computer Fraud and Abuse Act (18 U.S.C. §1030). Any unauthorized access, penetration testing, scanning, exploiting, or attempting to bypass security mechanisms is illegal. Zush will actively cooperate with federal agencies for prosecution.
3.2 Digital Millennium Copyright Act (DMCA). Copyright-infringing material uploaded via Zush services will be removed per §512. Repeated infringements lead to permanent termination.
3.3 General Data Protection Regulation (GDPR – EU 2016/679). Users in the EU/EEA cannot collect, store, or process personal data via Zush tools without lawful basis.
3.4 California Consumer Privacy Act (CCPA/CPRA). Users may not misuse Zush systems to collect personal information without explicit disclosure.
3.5 Information Technology Act 2000 (India). You may not engage in: Identity Theft (Sec 66C), Impersonation (Sec 66D), Distribution of obscene/illegal content (Sec 67/67B).
3.6 API Abuse & System Misuse. Strictly prohibited:
- Excessive rate-limit bypassing
- Reverse engineering
- Data scraping
- Multi-account automation
- Botting for fraudulent engagement metrics
- DDoS attempts or resource overload
3.7 Financial Fraud & Scams. Using Zush for scams, payment fraud, unauthorized giveaways, fake gifts, or impersonation of brands is a criminal offence.
4. CONTENT & USER RESPONSIBILITY
4.1 User-Generated Content. You are solely responsible for the legality, safety, and authenticity of all content you generate or upload.
4.2 No Illegal Distribution. You may NOT use Zush for:
- Pirated software
- Cracked or nulled scripts
- Malware, RATs, spyware, keyloggers
- Unauthorized access tools
4.3 Security Disclosure Policy. Users must not report vulnerabilities publicly. Coordinated disclosure via email only.
5. PRIVACY, DATA PROCESSING & LOGGING
5.1 Data Collection. Zush may collect:
- Server IDs
- Command Usage
- Logs for abuse detection
- IP-based rate control
- Security event telemetry
5.2 Zero Tolerance for Misuse. Attempting to harvest or redistribute Zush logs, databases, or user information is illegal.
5.3 Retention Policy. Logs are retained for security and legal compliance but may be purged periodically.
5.4 Law Enforcement Cooperation. Zush will comply with subpoenas, court orders, and legitimate governmental requests globally.
6. LIMITATION OF LIABILITY
6.1 "As Is" Services. Zush makes NO warranties, expressed or implied.
6.2 Maximum Liability. Total liability = $0.00 or the total amount paid by you in the last 12 months — whichever is lower.
6.3 Indirect Damages. Zush is not liable for:
- Lost profits
- Lost data
- Business interruption
- Damage caused by user misuse
- Third-party actions
7. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Zush against claims, damages, and losses arising from:
- Violation of these terms
- Violation of local or international laws
- Misuse of any Zush product
8. SERVICE MODIFICATION, SUSPENSION & TERMINATION
8.1 Right to Modify. Zush may modify or discontinue services at any time.
8.2 Immediate Suspension. Zush may suspend or terminate access for:
- Abuse
- Illegal activities
- Violations of Discord policies
- Security threats
- Chargeback attempts
8.3 No Refund Guarantee. All digital purchases are final.
9. GOVERNING LAW, ARBITRATION & CLASS-ACTION WAIVER
9.1 Governing Law. These Terms are governed by Delaware law.
9.2 Binding Arbitration.
- Any dispute → AAA arbitration.
- No jury trial.
- No class action.
9.3 International Users. You waive any rights inconsistent with Delaware law.
10. EXPORT CONTROL & SANCTIONS
10.1 OFAC Sanctions. Users located in embargoed regions (e.g., Iran, North Korea, Syria, Cuba, Crimea) cannot use Zush.
10.2 Export Restrictions. You may not export or re-export Zush software where prohibited by U.S. Export Administration Regulations (EAR).
11. FORCE MAJEURE
Zush is not responsible for failures caused by:
- War
- Natural disasters
- Internet outages
- Government actions
- Cyberattacks outside our control
12. MISCELLANEOUS
12.1 Severability. If any term is invalid, the rest remain enforceable.
12.2 Entire Agreement. These Terms supersede all prior agreements.
12.3 Waiver. Failure to enforce a term does not waive future enforcement.

PRIVACY POLICY

SECTION I: SECURITY PROTOCOLS (TOP PRIORITY)
We prioritize the security of your data above all else. Our infrastructure is built on a Zero-Trust architecture.
- Encryption in Transit: TLS 1.3 with AES-256-GCM cipher suites for all network traffic.
- Encryption at Rest: All database volumes are encrypted using XTS-AES-256.
- Hashing: Passwords and sensitive identifiers are hashed using Argon2id with individual salts.
- Audit Logging: Immutable logs of all administrative access are retained for 365 days.
SECTION II: DATA COLLECTION & USAGE
2.1 Data Minimization. We collect only what is strictly necessary to provide the Zush service.

SECTION IV: GOVERNMENT REQUESTS & LAW ENFORCEMENT
4.1 Subpoena Response Policy. We will only disclose user data to government agencies in response to valid, legally binding process (e.g., subpoenas, court orders, search warrants) issued by a court of competent jurisdiction.
4.2 Transparency Reports. Zush publishes an annual transparency report detailing the number of government requests received and the percentage of requests complied with.
4.3 Emergency Disclosure. We may disclose data without legal process if we have a good faith belief involving imminent danger of death or serious physical injury to any person.
